Thank you for using tools by Sunny Lemons Ltd. ("Sunny Lemons", "we" or "us"). By using our tools or accessing any Sunny Lemons services ("Services") available via Sunny Lemons websites, you agree to all the terms and conditions ("Terms"), together with any amendments, of this Terms of Service Agreement ("Agreement"). If you are using the Service on behalf of a company or other entity ("Company"), then you are agreeing to all these Terms on behalf of that Company, and you represent and warrant that you have the authority to bind the Company to this Agreement. In that case, "you" and "your" refers to you and that Company.

Data and Privacy

To use this tool, you must submit contact information such as your name, company name, and email address to generate and receive your assessment report. Our server software may also store basic technical information, such as your IP address, in memory or logs.

This data and contact information submitted by or for you to the Sunny Lemons Services, including electronic data and information submitted by or for you through your use of third-party applications, or collected and processed automatically by or for you using the Sunny Lemons Services is herein referred to as "Your Data".

Your Data may be used to:

- Deliver, maintain and improve our services

- Contact you about your assessment results

- Provide information about relevant Sunny Lemons services

- Conduct data analytics and research (in anonymised form)

- Ensure the security and reliability of our services

We may use artificial intelligence services to process your assessment data and generate insights. While we take reasonable steps to protect your data when using these services, you acknowledge that use of AI services involves transmission of data to third-party providers.

Sunny Lemons will never sell Your Data or make it accessible to third parties for marketing purposes. We may share anonymised, non-identifiable data for research or analytical purposes.

You may request deletion of Your Data at any time by emailing outreach@sunnylemons.co.uk. Deleted information may be kept in encrypted backups for up to 90 days for disaster recovery purposes only.

Third-Party Services

The Services include features that interoperate with online services operated by third-parties ("Third-Party Services"), pursuant to agreements between Sunny Lemons and the operators of such Third-Party Services or through application programming interfaces. These Third-Party Services are necessary for functions such as data processing and insight generation. Sunny Lemons ensures all third-party providers meet our security and privacy standards.

No Unlawful or Prohibited Uses

As a condition of your use of the Service, you will not use the Service for any purpose that is unlawful or prohibited by this Agreement. You may not use the Service in any manner that could damage, disable, overburden, impair or interfere with any other party's use of it. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Service.

Modification and Termination of Services

Sunny Lemons reserves the right to modify, update or discontinue our Services, or any features or portions thereof, without prior notice. You agree that we can suspend or terminate your right to access our Services at any time without notice, obligation or liability to you should you be found in violation of the Terms.

Limitation of Liability

The information and content provided by this tool does not constitute professional advice and is not intended to be a substitute for professional advice. All information and content are for general informational purposes only.

Applicable Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Your Data may be processed, stored, and used within the United Kingdom and European Economic Area. Data protection laws vary across jurisdictions, and different laws may be applicable to Your Data depending on where it is processed, stored, or used. We comply with UK GDPR and Data Protection Act 2018 requirements for data protection and privacy.
